What applies to you
- Whoever first makes a battery from a third country available in the EU is the importer and usually responsible for the passport (Art. 77(4)).
- Whoever sells a battery under their own name or trademark counts as the manufacturer, even if someone else produces it.
- Importers also check conformity assessment, CE marking and labels and state their name and address.
- Registration in the producer register of each member state is still required, in Germany with Stiftung EAR.
- Distributors without their own brand create no passport, but from 18 February 2027 may not offer batteries subject to the duty without one.
How to get the data
- 01Ask the manufacturer early; many do not yet know the requirements in detail
- 02Explicitly request the Annex XIII fields; a datasheet alone is rarely enough
- 03Fix data delivery and updates on model changes in the contract
- 04Receive serial numbers per delivery in a structured form, for example as CSV
- 05Check whether your manufacturer is already listed in the directory with address and models

Frequently asked questions
Can the manufacturer in China create the passport for me?
They can supply the data and may also be mandated in writing to maintain the passport. Responsibility remains with the economic operator who places the battery on the EU market.
What if my manufacturer does not reply?
No data, no complete passport. Ask early, fix delivery in the contract and check whether another supplier can provide the data.
Do you handle the registration in the EU registry?
Only the economic operator may register, with their own EU Login and a qualified seal. We prepare the file and enter the registration ID.
